Cancellation costs

In case of cancellation, you must bear the regular costs of return shipping if the delivered product matches the one ordered and the price of the item to be returned does not exceed €40.00, or, if the price of the item is higher, you have not yet passed consideration or made a contractually agreed partial payment, by the time of the cancellation. Otherwise you will not be charged for return shipping.

Right of Cancellation

You may cancel your contract within a period of 14 days without stating reasons, either by notifying us in writing (e.g., letter, fax, e-mail) or by returning the goods in question if these were transferred to you before the end of the said period. The cancellation period begins upon receipt of this notification in writing, at the earliest, but does not commence before reception of goods by the recipient (in the case of recurring deliveries of similar goods, not before reception of the first partial delivery) nor before we have complied with our duty to provide information pursuant to Article 246 Section 2 in conjunction with Section 1, Subsections 1 and 2 of the Introductory Law of the German Civil Code and our duties under Section 312g, Subsection 1, Sentence 1 of the German Civil Code in conjunction with Article 246, Section 3 of the Introductory Law of the German Civil Code. Timely dispatch of the cancellation notice or of the goods suffices to comply with the time limit provided for cancellation.

Consequences of Cancellation

In the event of effective cancellation, both parties must return what has been received in conjunction with the contract as well as surrendering any benefits obtained (e.g., those derived from use). If you are unable to restore the goods, services or benefits received (e.g., interest), or if you are only able to restore them in part or to return the goods in a deteriorated state, reimbursement will be sought for loss of value. Regarding the deterioration of goods and the benefits derived from their use, reimbursement will be sought for wear & tear caused by excessive use beyond a mere examination to determine a good's features and working principle. The "examination to determine a good's features and working principle", can be defined as the kind of testing and trials that are possible and customary, for example, in a shop. Goods capable of being sent by parcel post shall be returned to us at our risk. You shall bear the normal costs of return shipping if the goods received match those ordered and if the price of the goods to be returned does not exceed €40; the same shall apply to higher-priced goods if at the time of cancellation you have not yet passed consideration or made a partial payment as agreed upon in the contract. In all other cases, you may return the goods free of charge. Goods which cannot be sent by parcel post will be picked up at your address. The obligation to refund payments must be fulfilled within 30 days. For you, this period begins upon posting the declaration of cancellation or the goods; for us, it begins upon their receipt.

Exceptions

This right does not exist for distance selling contracts involving the delivery of audio or video recordings or software if the delivered data carriers have been unsealed by the consumer.
